I got a feeling America has a bit of an immigration problem




The good news for homebuilders, versus software firms, is that they don't have to go through an interview process and H1-B visas.

No, our homebuilder friends just illegally use illegals who illegally walked over the border. Or "used" I should say, as the millions of illegals who used to build homes are no longer needed.

But for the Microsofts, etc of the world, who want to import smart yet cheap people (on planes) to replace American workers, check out this video. Nice to see the system being gamed so easily.

Get the feeling that corruption in our modern American society is everywhere folks?

In all seriousness, I don't get it. Why should I care about 'the American worker'? If Indian workers can do a better job at a cheaper price, I am all for it.

Personally, I am more sympathetic to industrious third-worlders developing skills and creating wealth in a former (current?) backwater, than I am to fat off the hog 'American workers' who have been sucking down government subsidies, and buying Hummers and McMansions off of easy money.

'The American worker' should develop marketable skills which can't be undercut by cheap overseas labor. But, god forbid, this might require getting education and taking initiative.

I think we've finally found a law firm to make an example of in an unambigious, physical confrontation!! It is time to bring activity to the front door of this law firm and to the home addresses of all the lawyers in that firm, so as to affect their reputations and economic viability.

I see this as "Conspiracy To Unlawfully Discriminate In Employment Based Upon National Origin." It is clear to me they intend to avoid AMERICAN workers and I believe this is legally actionable. I wonder if a class action lawsuit can be brought against this law firm and perhaps every company that employs H1-B Visa employees because it may be that they intentionally engaged in a pattern of behavior designed to unlawfully discriminate against AMERICANS?

It seems to me that what this law firm and perhaps its clients are doing can be viewed as both a federal civil rights violation (of American applicants) and perhaps even a federal felony.

CORRECTION: The only corruption is by politicians who want to reward companies who engage in employing slave labor by offering fresh supplies of this labor.

When we reward illegal activities by legitimization (giving amnesty to those who snuck in here and who steal identities of hard-working people), all we are doing is inviting more people to sneak in. Since these people have broken a law, they are forced to work harder, and for less money than their legal conterparts.

I honestly think it has less to do with the cheapness of the workers, rather than the smartness (or lack thereof) of the American worker. Let's face it, our education system is awful. I know of employers that simply can't find qualified Americans to fill the most, especially in Science. The salaries are the same, generally, wether a US born citizen fills the post over a foreign born one.

People who think that under cutting U.S. labor with cheap imported labor simply makes good free market sense don't understand the overall effect on this economy. Downward pressure on wages in an inflationary environment will spell disaster for our retail and housing driven economy. Anyone who has looked at the numbers, durable goods orders are down 2.8% more than expected for example and Real GDP has been down for months, knows that we are already in a recession. Keeping U.S. workers unemployed or underpaid is a surefire way to deepen and extend that recession. Globalization has serious side effects that no one is considering here. Idiots who oversimplify the issue as racists vs. the enlightened generally have no clue what they are talking about.
And what marketable skills should Americans acquire that cannot be outsourced? Programming, accounting, radiology, customer support, banking, what? All those skills can and are being outsourced. It's the unskilled labor that is not being outsourced because it can only be done onsight such as construction. Multinationals have bought off many of our representatives in Congress as well as this administration to screw the U.S. working class and force the middle class to subsidize the importation of cheap labor from Mexico and Central America. In other words, we are subsidizing our replacement workers while Corporations such as the homebuilders enjoy reduced wage expenses.
Please get clue.

Bull. Salaries are being driven down through this program. I am an American tech worker - I am unemployed. I am getting really crummy salary offers far below what I got 5 years ago.

Why? Because they know that if I don't take the job, then they can claim they "couldn't find" a qualified American to do the work. So they import some lesser skilled indian at 1/3 the price. This artificially inflates the supply and undermines my bargaining position.

Indian workers are not "better" - they are often worse due to cultural mismatch. They are cheaper because the ones that come here are typically very young, used to living frugally and the money they send home goes VERY far with their family in India.

Meanwhile, lots of top quality Americans have left the tech industry over the last 5 years because of this dynamic. They would come back if it became lucrative again. But our costs are higher - we need more money to live.

I'm sick of the myth of the 'superior indian'. Back it up. Publish all positions filled by H1B workers. Allow any American to challenge for the worker's job at any time. I think we'll be finding a lot of Indians heading home. I won't have any trouble sending back any of the ones I've met.

Well, in bringing back the immigration bill they promised to have amendments. But looks like that got tabled. Not sure some senators are going to vote for it now. Just a shamnesty bill.

Also, the 4B Bush promised for more security is not in the bill.

Also, employee sanctions can be waived.

Moreover, most of the senators have no idea what they are voting for -- the bill is roughly 800 pages.

I think the ceiling for h1b can be adjusted every year.

Yep, southern presidents creating a new global slave plantation. I hear the willing slaves whining about racism. Thats what they always do when they feel threatened and go into fear mode.

India, etc., are rapidly industrializing. The Western world is no longer unique at providing reliable banking, customer service, radiology, and programming. These jobs will either go to Indians in India, or to Americans at wages lower than those of the past. That's the reality, and I don't see how stomping our foot will change that.

Nor should we want to, really, because we should believe that each human being is equal. Helping Americans by screwing Indians - even if it could be done, which it can't, long term - is wrong.

While the lawyers may be playing it up to their advantage, there really is a shortage of high-skilled US labor (at least in the IT field, in which I work). It's not like foreign skilled labor comes all that cheap, either.

The simple fact is that we do not produce enough engineers, scientists, programmers, systems analysts and architects, etc. and have to import them instead. At least with an H-1B they're here, paying taxes and contributing to the health of the economy. The alternative would be to outsource, and have the work done overseas. How is that better?

Also, a great many of the H-1B workers go on to become citizens, highly educated and highly paid citizens.

If you doubt me about the lack of US skilled workers, go to a college graduation sometime. The business majors are legion. When it comes time for the science and engineering schools to get up and get their degrees, it gets quite a bit thinner, and even then it is largely composed of Nguyen's and Patel's, who have immigrated here.

We're a nation of managers, with nothing to manage, and without deep skillsets.

I got a lot of H1-B friends who earn 60-100k per year. Which I don't think is cheap unless you people are saying that a 70k annual salary is cheap.

Well if 70k is considered dirt pay by Americans - then it's the Americans who have a problem (greed) and companies should be able to hire foreigners.

Again - this is about H1-B workers and not illegal mexicans.

There is no shortage of skilled American labor. There's plenty of degreed American engineers, software developers and computer scientists.

These Americans built Microsoft, Boeing, Sybase, Informix, Siebel, Pixar, Oracle, Sun, Yahoo, Google, Netscape, HP, IBM, Intel, Cisco, Dell, IBM, Compaq, and dozens of other unbelievable rich companies.

They just wont accept for dirt low Asian or Eastern European wages.

Hence they're being pushed out and being replaced by foreign scab workers and outsourced. And those who've been around since the 80S or early 90s are taking big salary hits.

American greed at its absolute worst.

Someone make a business case for me here.

Why would any USA kid want to go to a top 4 year engineering school and spend over 80K to compete against another kid that goes to subsidized school in India who only pays 6K for a 4 year program????

I too am an American tech worker and what you say is untrue. I make over twice what I made 5 years ago. If I got fired today by Monday I would have a new job. Not a week goes by without a recruiter calling me.

I have a feeling the reason you are unemployed is because you haven't learned a new skill in 5 years. Instead of looking at that as the reason, you blame immigrants for "stealing" your job.

I couldn't find the other youtube video in which another lawyer from the same law firm talks to Maria Bartoramo on CNBC about "labor shortage" in the US. On the first video the law firm teaches employers how to pretend that all American applicants are not qualified, in order to hire cheaper foreign labor. On the second video, the lawyer goes on CNBC to sell and brainwash the sheeple of how there's a shortage of American labor and how we need more H-B1 visas to bring in foreign workers.

Your job is not safe at all, especially if you earn over $100k. I know because it happened to my wife. After working 10 years for the same company, they replaced her with a foreign worker for half the price, and after she had built the entire department. She has advanced degrees, speaks foreign languages, has project management certification, etc.

Some idiots and crooks say "well, you should get more skills, blah, blah, blah..." We are already the most skilled workforce in the world. Do you guys want us to be what, a superworker from comic books to earn $50K / year? How do you think that this country was built before all these H-B1 visas start to pop everywhere, with poor American skills? Do you really thina are growing on their own without copying all the knowledge that Americans built? This is just another excuse from greedy corporations who want cheap labor.

China and India should thank Wal-Mart, Target, GE, Microsoft, Home Depot, Oracle, etc, for taking everything that Americans built and invented and transferring to those countries. All that to save a buck and look good to Wall Street. Read the book "The World is Flat" by Thomas Friedman, because it's all in there.

Can you believe that executives from GE and IBM had to convince Indians to open their country to accept all the technology that was invented first by the American worker? It took years of frustrating negotiations for the Indian government to accept.

Without the American worker, India and China would be nothing. Now that they got everything easy and we are teaching them even how to study (major American Universities are setting up shop on those countries, as you know), they feel cocky, like they have accomplished anything on their own.
